Terms of Service

These Terms of Service ("Terms") govern your access to and use of the 30 Day Challenge app (the "App" or "Service") operated by us. By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

1) Acceptance of Terms

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2) Eligibility and User Accounts

To use the App, you must:

  • Be at least 13 years of age (or the minimum age required by law in your jurisdiction).
  • Have the legal capacity to enter into binding agreements.
  • Provide accurate, current, and complete information when creating an account.
  • Maintain and promptly update your account information to keep it accurate.
  • Maintain the security of your account credentials and notify us immediately of any unauthorized access.
  • Be responsible for all activities that occur under your account.

You may not share your account credentials with others or allow others to access your account. You are responsible for maintaining the confidentiality of your account information.

3) User Rights and Responsibilities

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
  • Use the Service to transmit any viruses, worms, or other malicious code.
  • Collect or store personal data about other users without their express permission.
  • Use automated systems (bots, scrapers) to access the Service without our express written permission.
  • Reverse engineer, decompile, or disassemble any portion of the App.

You are solely responsible for all content you post, upload, or transmit through the App, including but not limited to posts, comments, activity logs, and chat messages.

4) Intellectual Property Rights

The App and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create, post, or upload to the App ("User Content"). However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating and providing the Service.

You represent and warrant that you own or have the necessary rights to grant the license described above for any User Content you submit.

5) Payment Terms

Currently, the App is provided free of charge. If we introduce paid features, subscriptions, or in-app purchases in the future, we will notify you in advance and update these Terms accordingly. Any payment terms will be clearly disclosed before you make a purchase.

6) AI Coach Feature

The App includes an AI Coach feature that provides personalized guidance and responses. You acknowledge that:

  • AI-generated responses are provided for informational and motivational purposes only and do not constitute professional medical, legal, financial, or therapeutic advice.
  • You should not rely solely on AI Coach responses for making important decisions.
  • We may impose daily limits on AI Coach usage to ensure fair access and prevent abuse.
  • AI responses are generated using third-party services (OpenAI) and may contain errors or inaccuracies.

7) Termination of Service

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, for any reason, including but not limited to:

  • Violation of these Terms or our Privacy Policy.
  • Fraudulent, abusive, or illegal activity.
  • Extended periods of inactivity.
  • At your request for account deletion.

You may terminate your account at any time by contacting us or using account deletion features within the App. Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our Privacy Policy.

8) Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the Service will be accurate or reliable.
  • Any errors in the Service will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

9) Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Please review our Privacy Policy at /privacy-policy to understand our practices.

10) Third-Party Services

The App may integrate with or link to third-party services, including but not limited to:

  • Supabase: For hosting, database, and authentication services.
  • OpenAI: For AI-powered features and responses.
  • Google/Apple: For sign-in authentication.

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

11) Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts in our jurisdiction.

12) Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by posting the new Terms on this page and updating the "Effective date" at the top. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

13) Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14) Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service and supersede all prior agreements and understandings.
